  • A happy - sad day

And it has nothing to do with the Cardinals.

28 years ago today a plane carrying Lynard Skynard crashed. When I heard about it, I cried like a damn baby. I might have been a little high.

17 years ago today my son Kevin was born. He is our second and the doctors had decided in advance to go Ceasarian. We could choose October 18, 20, or 23rd. I wanted the 20th, to offset the bad memories on that day.

And now he's a guitar playing fool, somewhat like his dad in that respect.

    Happy birthday Kev!

He's the younger of the two.

He never really cared for hockey.

Both of my boys play or played hockey. They both also played guitar...badly.

            Luckily my daughter played piano.

Hope Kevin had a Happy Birthday.

The worst part is that it didn't kill off the whole band.
From this day forward, I no longer shall tinker with the machinery of death.

For more than 20 years I have endeavored-indeed, I have struggled-along with a majority of this Court, to develop procedural & substantive rules that would lend more than the mere appearance of fairness to the death penalty endeavor.

I feel morally and intellectually obligated simply to concede that the death penalty experiment has failed.

The path the Court has chosen lessens us all. I dissent.
